National Park Bye-Laws – A Livestock Case Study | Livestock

Recently a Solicitors in Southampton (UK) have been successful in maintaining the traditional byelaws and principals that still exist in the National Parks of the United Kingdom and a recent court victory underpins this.

o Safeguard a viable future for commoning upon which the foregoing depends.These laws have been in place since the New Forest Act 1877 and these Verderers are still appointed to uphold these unique laws and govern the area, which includes the management of the local farmers and the livestock which live on land that is officially owned by the crown.Despite the vast amount of Crown land in the United Kingdom, this is actually a very rare privilege; but these supposed ‘commoners’ are required to identify their livestock by individually tagging them to facilitate the identification of their particular owners if the animal is found dead, injured or outside of the lands.The partner of the Hampshire Solicitors stated that the defendant was at liberty to graze any of his livestock in the New Forest; however, between the dates of March-June 2007 his livestock were seen on several occasions without ear tags that could be used to identify the owner of the particular animal. The defendant was requested several times to tag these cattle but failed to adequately do so.The defendant was originally found guilty of this offence in 2008 but decided to appeal against the original judgement, stating that the byelaws of the forest were void and that the need to tag his livestock was redundant.
He recently failed in this appeal and actually received a warning by the Crown Court Recorder to not underestimate the traditional ethics and byelaws of the New Forest.The partner of the Solicitors in Hampshire stated that he and his team were “very happy to act on behalf of the Verderers who do a very special job”. He went on to express how happy he was of the successful outcome.
This successful outcome is surely a huge positive for the people of the New Forest who support the efforts of the Verderers in conserving the ethics, environment and all inhabitants of this wonderful area of the country.
